Introduction

Sexual harassment results in violation of the fundamental rights of a woman to equality and her right to life and to live with dignity and right to practice any profession or to carry on any occupation, trade or business which includes a right to a safe environment free from sexual harassment under the Constitution of India.

The ‘Internal Complaints Committee’ is constituted under the directives of Hon’ble Supreme Court of India to provide a platform to file complaints related to sexual harassment of women at workplace under the Sexual Harassment of Women at workplace (Prevention, Prohibition and Redressal) Act, 2013 [Prevention of Sexual Harassment (PoSH) Act, 2013].

Complaint procedure

Sexual harassment includes any one or more of the following unwelcome acts or behavior (whether directly or by implication) namely:

Any aggrieved woman may make, in writing, a complaint of sexual harassment to the Internal Complaints Committee within a period of three months from the date of incident and in case of a series of incidents, within a period of three months from the date of last incident. If the complaint cannot be made in writing, the Presiding Officer or any member of the Committee will render all reasonable assistance the woman for making the complaint in writing. If the Committee is satisfied that the circumstances were such which prevented the woman from filing a complaint within three months, it can extend the time limit. When the aggrieved woman is unable to make a complaint on account of her physical or mental incapability or death or otherwise, her legal heir or such other person may make a complaint.
